- GuardianshipA “TEDRA Petition†is a form of a lawsuit which is used to bring the disputed issue before the Court with jurisdiction over the probate or guardianship estate or trust. In a TEDRA Petition, the Court is made aware of the existence of the dispute and asked to grant the relief requested by the “Petitioner†. The other interested parties to the probate or guardianship or trust proceeding are given notice of the fact that the Petition has been brought before the Court by the issuance of a TEDRA summons, and have a right to also file an answer or response to the Petition in which they can object to the relief being requested.
- Restraining OrderThe Act is intended to protect such people from the abuse, neglect and financial exploitation by others. Â Remedies available in court can include restraining orders to protect these vulnerable people from ongoing abuse or exploitation by other people. Â
- Real Estate LitigationThe choice of words used in real estate documents can also be critical in ensuring that a client’s intent and needs are captured.   We have a number of attorneys at Newton Kight who have significant knowledge of and experience in real estate matters who are ready to assist in the negotiating, drafting and/or review of real estate documents.
- Real Estate TransactionsClients want their real estate transactions to be clear, comprehensive, functional and enforceable. Â For these reasons, and because Washington law often requires it, an agreement involving real estate should be made in a writing signed by all of the parties.
- Personal InjuryThe legal services we provide are Estate Planning, Trusts, Probate, Guardianship, Elder Law, Family Law, Divorce, Adoption, Civil Litigation, Collection, Real Estate, Landlord/Tenant, Personal Injury, and Business Formations. The attorneys at Newton Kight L.L.P. provide legal services for clients in Snohomish, King, Island and Skagit County, Washington, including communities such as Everett, Arlington, Burlington, Marysville, Mount Vernon, Lake Stevens, Snohomish, Monroe, Lynnwood, Mukilteo, Mountlake Terrace, Camano Island, Edmonds and Brier.
- Estate PlanningWe also know that the need for legal services may not become apparent until after a real estate document has been signed, and perhaps until a question or dispute has arisen. Â Indeed real estate questions and transactions appear in a number of contexts, such as in estate planning and probate matters.
- WillsA person who dies without having a valid Last Will and Testament is said to be “intestate†.  The money and property owned by a person dying intestate passes to their heirs at law under the laws of Intestate Succession.  The statute in Washington law can be found at RCW 11.04.015.
- TrustsA Special Needs Trust (sometimes also called a “Supplemental Needs Trust†) is a specific kind of living trust for the use of a disabled beneficiary who either is, or at some time in the future may be, eligible to receive certain types of benefits or State or Federal assistance that is based upon the financial needs of the beneficiary.  For example, Medicaid, COPES, SSI, and Section 8 housing are all programs that will provide benefits to persons who qualify as indigent (which usually means having less than $2,000 in nonexempt resources). If such disabled person is to receive or inherit a lump sum of money, the funds can sometimes be protected for the use of the disabled person without disqualifying them from continuing to receive such benefits, through the use of a Special Needs Trust. Â
