- Child SupportIn addition to custody decisions, the court will determine parent time (visitation) schedules and child support obligations. Child support is calculated using statutory tables based on the income of each parent and the amount of time spent in each household. It is unusual for the courts to order a child support amount different than this statutory calculation.
- Child Custody and VisitationDivorce impacts more than just the two separating parties, it has implications on the entire family. In fact, many of the most complicated components of divorce are those that deal with the children. Whether it be a battle for custody or matters of child support, there are considerable sums of money and the well-being of children at stake. In light of this, it is natural to want this process to go as quickly as possible. Quality legal representation is crucial in correctly navigating these turbulent waters in a timely manner. Oftentimes the question of child custody can only be settled by a judge, who must listen to both sides as they argue their case for why they are most fit to be the guardian of the child. You may think that involving the courts is an unnecessary step, but if your former spouse demands to hash things out before a judge, it is best that you have an experienced lawyer by your side who can present the best argument for your child’s wellbeing.

- Personal InjuryGenerally, any debt that is not fraudulent, a domestic support obligation, education-related, new taxes or business taxes, personal injury if you were drunk, or willfully or maliciously incurred is eligible for discharge in a chapter 7. Most medical bills, credit cards, and loans can be discharged in a chapter 7. Since there are always exceptions, if you have an unusual debt, we would need to meet with you to discuss your situation.
- BankruptcyChapter 13 bankruptcy allows you to reorganize or modify most or all of your debts so you can keep your assets and pay your creditors in a way that is better for you, not for them. You will create a plan to pay off your creditors with one monthly payment and can often get the terms of the debts adjusted so you can afford to pay them off. In many cases you actually pay less in a chapter 13 than you would in a chapter 7 (typically in cases where you are retaining secured assets such as vehicles).
- ForeclosureA chapter 13 will stop a foreclosure at any time before the trustee’s sale. This means that you can stay in your home and bring current your mortgage payments. As you pay your monthly payment according to your plan, the bankruptcy trustee makes payments to your mortgage company to bring current your house payments. You cannot do this in a chapter 7.
